Probate

Compassionate guidance through probate.

When a loved one passes, their affairs are settled through the probate court: a personal representative is appointed, debts are paid, and property is distributed to heirs. David guides families through each step with care and attention to detail.

Probate services

Every estate is different. The firm regularly assists with the following matters.

Probate administration

Opening the estate, appointing the personal representative, collecting assets, negotiating and paying debts, handling tax consequences, and distributing property to heirs.

Probate litigation

Representing an individual, an estate, or a trust when family members disagree about competency, distributions, fees, asset values, or property wrongfully taken by another.

Will contests and challenges

A will can be challenged if it was signed under duress or undue influence, if the person was not competent, or if Michigan's signing and witnessing formalities were not met.

Guardianships and conservatorships

Court appointment of a guardian to make personal and medical decisions, or a conservator to manage finances, for an incapacitated adult, or for a minor entitled to receive funds from an inheritance or settlement.

Guide

First steps after a loss

Take care of yourself and your family first. When you are ready:

  • Request several certified copies of the death certificate
  • Locate the original will or trust and keep it safe
  • Secure the home, vehicles, and mail
  • Do not distribute money or property until the estate is properly opened
  • Consult an attorney before paying creditors or closing accounts

Does this estate need probate?

Answer two questions for a general sense of what to expect. This is not legal advice.

Did the person own anything in their name alone, with no joint owner and no named beneficiary? A house, an account, a car.
Was that property held in a trust?
